Terms & Policy
These Terms and Policy (“Agreement”) govern the relationship between JH Nanny and Nest (“Company”) and families and babysitters (“Clients” and “Sitters”) using the matching services. By using our service, you agree to these terms.
1. Scope of Services
• JH Nanny and Nest provides a matching platform/referral service: screening Sitters, sharing profiles, and facilitating introductions.
• The Company does not employ Sitters; Sitters are independent contractors engaged directly by Clients.

2. Booking Process and Fees
Initial Inquiry & Match
• Client submits request (dates, times, number/ages of children).
• Company matches the client with a suitable Sitters.
Booking Confirmation
• At confirmation, a $10/hour Booking Fee is charged to the Client with a 4 hour minimum. This fee is non-refundable, even if the booking is later canceled, except as required by law.
3. Payment of Booking Fee
• The Booking Fee is collected by JH Nanny and Nest through venmo at the time of booking confirmation.
4. Rates and Payment to Sitters
• Base Service Rate:
Pro Sitters: $30.00 per hour for up to two (2) children.
Teen Sitters: $25.00 per hour for up to two (2) children.
Mother’s Helper: $10-15 per hour for up to two (2) children.
• Additional Children: $3.00 per hour for each additional child beyond two.
• Payment to Sitters:
• Clients pay Sitters directly at the time of service.
• Accepted payment methods should be agreed upon between Client and Sitter in advance.
• The Company encourages timely, complete payment immediately after or during the service period.
5. Cancellation Policy
• Standard Cancellation: If Client cancels more than 24 hours before the scheduled start time, no additional cancellation fee is charged; however, the Booking Fee remains non-refundable.
• Late Cancellation (within 24 hours): If Client cancels less than 24 hours before the scheduled service start time, Client owes a Cancellation Fee equal to half of the agreed Service
• This fee is payable to the Sitter if they are unable to fill that slot (subject to Sitter’s confirmation and the Company’s matching records).
• Client agrees to pay this fee promptly via the agreed payment method.
• Sitter-Initiated Cancellation: If a Sitter cancels within 24 hours, the Company will attempt to find a replacement. If no replacement is available, no Cancellation Fee is owed by Client; any Booking Fee will be returned.
8. Liability & Insurance
• Limitation of Liability:
• JH Nanny and Nest is a referral/matching service and is not the employer of Sitters. The Company disclaims liability for acts or omissions of Sitters once matched.
• Client and Sitter agree to hold the Company harmless from claims arising from the childcare arrangement, except in cases of Company’s gross negligence in screening (to the extent permitted by law).
• Insurance:
• Clients are encouraged to verify that Sitters carry appropriate liability insurance if desired. The Company may offer or recommend insurance options but does not guarantee coverage.
• Emergencies:
• Sitters must follow Client’s emergency protocols and contact emergency services when necessary. Client should provide clear instructions and contact info.
10. Amendments
• The Company may update these Terms from time to time. Clients and Sitters will be notified of material changes. Continued use after notification constitutes acceptance.
• Clients or Sitters with concerns about changes may contact the Company within a specified period (e.g., 14 days) to discuss.
11. Governing Law
• This Agreement is governed by the laws of the jurisdiction in which JH Nanny and Nest is established (specify state/province). Disputes shall be resolved in the appropriate courts of that jurisdiction.
12. Severability
• If any provision of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect.

14. Acknowledgment
By confirming a booking or registering as a Sitter, you acknowledge that you have read, understood, and agree to abide by these Terms and Policy.
Non-Circumvention / Rebooking
• Mandatory Use of Agency: If a Client wishes to rebook a Sitter previously matched, the Client must do so through JH Nanny and Nest and pay the Booking Fee again.
• Prohibition on Direct Engagement: Clients may not contact or engage Sitters introduced by the Company directly for future services without going through JH Nanny and Nest.
• Non-Circumvention Fee: If the Company learns that a Client has arranged direct bookings with a Sitter introduced by the Company (bypassing the platform), the Client owes a Non-Circumvention Fee equal to the standard Booking Fee ($10) for each such direct engagement, payable to the Company. This is in addition to any other remedies the Company may have.
• This clause survives termination of any particular booking; it applies whenever the Client and Sitter first connected via the Company.
